Father of Sherin Mathews indicted for capital murder

A Dallas County grand jury has indicted Wesley Mathews on charges of capital murder and tampering with physical evidence in the death of his adopted daughter, Sherin Mathews.

Authorities later found Sherin's body in a culvert beneath a road. According to court records, he told police he had been helping the girl drink milk when she choked, and when he eventually felt no pulse, he believed the child had died.

Mathews previously was charged with injury to a child, a first-degree felony punishable with a maximum 99 years in prison, police in the Dallas suburb of Richardson said.

If convicted on the capital murder charge, Wesley Mathews faces the death penalty or life in prison without parole. "We do want to make sure that justice is done, on behalf of this little three year old", says DA Johnson.

"We have some information in terms of what might have happened, but we are still investigating", District Attorney Faith Johnson said during a Friday news conference, adding that her office had not decided whether it would seek the death penalty.

The medical examiner ruled Sherin Mathews' death a homicide but could not determine exactly how she died.

When Dakil reported her findings to Sini Mathews, the mother said she disagreed with the findings and told the pediatrician that a report to Child Protective Services would "ruin her weekend", Dakil said.

Wesley Mathews and his wife, Sini Mathews, who is charged with child abandonment for allegedly leaving her daughter home alone while the rest of the family went out to a restaurant, reported their daughter missing in October, telling police that she'd disappeared after being forced to stand in the alley behind the Mathews' home in Richardson as punishment for not drinking her milk. "The 3-year-old began to choke".

They say he later changed his story and said she choked to death on milk and that he got rid of her body in the storm drain not far from their home.

Wesley Mathews was jailed on $1 million bond last fall. Johnson said she would seek a higher amount.

Mathews admitted to police he removed the body from the home after she died, continued the affidavit.
