The footage taken in 2014 was released after a lawsuit brought by Angilau's family was dismissed.

In the 24-second clip, Angilau is seen suddenly standing up at the defendant table, grabbing a pen or pencil near him and running toward the witness stand, where another member of the gang was testifying. He attempted to stab the witness but missed and fell onto the floor.

He said the video shows that the marshal "panicked" and should have used other methods to subdue Angilau.

Angilau was an alleged leader of a local street gang called the "Tonga Crip Gang".

Dramatic footage has been released of the moment an alleged gang member launches himself at a witness inside a courtroom before being shot dead. The police marshal's identity is now under suppression.

Dowdell granted the summary judgment Friday and dismissed the plaintiff's excessive force lawsuit.

The family of Siale Angilau, 25, have argued that the United States marshal who shot him dead used excessive force. Angilau (pictured) is no longer visible at that point.


Angilau's family wanted a jury to see the video to see if the marshal used appropriate force after the Federal Bureau of Investigation found the shooting was justified. He also noted that the defendant was already on the ground when the Marshall fired the final three shots, CBS News also reported.

Skyes said: "There was no need to use deadly force".

"Angilau was in custody, but he essentially had escaped custodial control for those seconds during which he was executing his plan to assault the witness", the judge wrote. "His attack was stopped by the shots that Jane Doe rapidly fired, in less than one and one-half seconds".

But he said the family is glad the video has been made public - and that they want justice.

He was in court after being one of 17 people named in a 29-count racketeering indictment filed in 2008, which accused gang members of conspiracy, assault, robbery and weapons offenses. He was the last of the defendants to stand trial, with other gang members having received prison sentences ranging from 10 to 30 years.

A mistrial was declared after the shooting.

Faces of the judge, attorneys and jurors are blurred out.

The media coalition including the AP fought for several years with government attorneys to have the video released publicly, arguing that the shooting raised questions about police use of force and upholding the principle of open courts.
