Alfie Evans' parents lose legal bid in attempt to save son

He sought to overturn Mr Justice Hayden's decision last week that Alfie's parents may not remove him from Alder Hey hospital. The hearing was conducted in the Court of Justice in Westminster before Lord Justice Davis, Lady Justice King and Lord Justice Moylan.

The Court of Appeal in the United Kingdom ruled against the parents of a 23-month-old boy on life support.

He then alleged the hospital called the police to prevent him removing his son, with officers allegedly telling him he would be "arrested for assault" if he attempted to remove Alfie.

Up to one thousand protesters campaigned outside the Alder Hey complex last night, waving placards and chanting in support of the 23-month-old.

The toddler is battling an undiagnosed brain disease, according to reports.

The justice stated that the parental rights of Tom and Kate over Alife "do not take precedence".


The judge said he would make a decision on what is best for Alfie if agreement is not reached and indicated any case would start in February.

"As has been determined with considerable clarity in this case, Alfie's best interests are determinative and the court has decided what treatment he should or should not receive. In our view the arguments advanced on behalf of the parents provide no basis on which Alfie could be said to be detained, or on which he could to be said to be unlawfully detained", Moylan said, according to Liverpool Echo.

Alfie was born to parents Tom Evans and Kate James, from Bootle, on 9 May 2016.

However, Alder Hey said in a statement: "Noise from recent protests has unfortunately affected our patients so we would ask that noise levels outside the hospital are kept to a minimum and, for example, auto horns are not sounded". The decision was delivered today at the Court of Justice at about 4:20 PM London time.

Doctors said he had a degenerative neurological condition which they have not been able to identify definitively.

On 28 March judges at the European Court of Human Rights rejected a bid from Mr Evans and Ms James to examine issues relating to Alfie's future, ruling there was no appearance of any human rights violation. The court expressly determined that it would be lawful, because treatment would be in Alfie's best interests and that no other available course would be.
