SC refuses urgent hearing on plea against Nanak Shah Fakir's release

A bench of Chief Justice Dipak Misra, Justice AM Khanwilkar and Justice DY Chandrachud told petitioner Satinder Singh Gulati that the Central Board of Film Certification had cleared the film for release and it can't be objected to without taking recourse to lawful means. The court denied to hear the matter on Thursday or Friday, and posted the matter for Monday.

Sikka had filed a civil writ petition in the Supreme Court seeking protection for screening of the movie in theatres. In court, Sikka maintained that the changes were made, and were accepted by the CBFC as well.

The Cinematograph (Certification) Rules 1983 says that under sec.11 that it specifically imposes a duty on the Board to assess public reaction to films, which can be by holding symposia or seminars of film critics, film writers, community leaders and persons engaged in the film industry and also by undertaking local or national survey to study the impact of the film on the mind of the viewers. "Outsiders can not be allowed to curtail the freedom of speech and expression".


He mentioned the plea for an urgent hearing.

A bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar said the "release of the film can not be interdicted". The film allegedly portrays Guru Nanak and his family members in such a manner that has hurt the sentiments of the community, according to The Times of India. The top Sikh body, had earlier asked the producer of the movie not to release the movie, which is based on the life and teachings of the first Sikh guru, Guru Nanak Dev.

The High Court directed the Centre to ensure maintenance of law and order and made it clear that it was not granting any ex-parte relief to DSGMC without hearing the film producer. In a warning to the Punjab and Union governments, the Jathedar said both governments would be responsible for any untoward outcome after the release of movie since Sikh religious sentiments were highly inflamed and hurt.

It had said after the CBFC certification, no group, body, association or individuals can create any kind of disturbance in exhibition of the film.
