Attorney General Jeff Sessions declined to say Wednesday if he has recused himself from the investigation into President Trump's personal attorney Michael Cohen.
"I should not answer that question; it would be inappropriate to do so", Sessions said at a Senate Appropriations subcommittee hearing.
Trump had repeatedly criticized Sessions over his recusal from Mueller's investigation and lashed out against the raids in the Cohen investigation.
He said recusals are typically not made public, a point echoed by Justice Department Spokeswoman Sarah Isgur Flores.
However, by not recusing himself from the Cohen probe, he is now entitled to attend briefings on the status of the investigation being conducted by the Southern District of NY.
"It is the policy of the Department of Justice that those who recuse themselves not state the details of it".
Sessions told the committee that the Justice Department does not generally comment on recusals or their scope.
Leahy, the senior Democrat on the Senate Appropriations Committee, had pressed him about Cohen, whose office and home were raided earlier this month after the Federal Bureau of Investigation received a referral from the special counsel investigating whether members of Trump's 2016 presidential campaign colluded with Russian Federation during the election.
Attorney General Jeff Sessions is not backing down this time.
"That calls for a speculative answer", Sessions said. "I am not able to do that", Sessions said.
Sessions is recused from overseeing Special Counsel Robert Mueller's Russian Federation probe, but it has been reported that Sessions has not recused himself from the Cohen investigation, aside from specific questions he may step back from, according to Bloomberg.
Sessions could also reportedly weigh in on specific decisions by prosecutors, including whether to pursue subpoenas and indictments.
Mr. Sessions recused himself previous year from the Justice Department's investigation of Russian meddling in the 2016 presidential election.
Sessions, a former Republican senator, had agreed to recuse himself from any Justice Department investigation into campaign interference after he worked to help Trump win the election. Mr. Rosenstein signed the search warrant authorizing the raid on Mr. Cohen's office, hotel room and home.
