Jury nullification is when a jury finds a defendant not guilty because they do not support a government's law. Now, the Cupertino firm is demanding that the South Korean giant pay up $1 billion for using its iPhone design patents.

But Samsung's attorney, John Quinn, held up specific phone components - screens and displays - and told a jury that's where the infringement took place.

Meanwhile, the patent trial which kicked off yesterday with jury selection was proved so hard to find unbiased jurors that choosing eight of them from the 74 candidates took an nearly whole day. It argues that customers were not only buying its handsets because of the design, but also due to their "functionality".

Later Koh admonished Quinn saying what he did was tantamount to jury nullification.


The two companies are contesting whether Apple's patents protect part of the iPhone or the whole of it, CNET reports.

At issue were design features by now familiar to consumers: a black, rectangular, round-cornered phone front, a surrounding rim, known as the "bezel" and a grid of 16 colorful icon.

The arguments are centred around "articles of manufacture", a legal term to describe the portions of a device covered by a patent.

In December 2016, eight Supreme Court judges favored its contention and decided that it wasn't right that lower courts ought to dependably consider the "significant article of make" in such cases to be the finished result sold to customers. The glass is easily separated from the phone and doesn't cost much, Samsung has argued. "Apple is certainly not entitled to the profits on the whole phone".

Apple wants Samsung to pay the full damage amount of $1 billion. Koh has forbidden that argument on the ground that Samsung didn't raise it in the previous trial or on appeal.

The trial over damages related to patent infringement also gives a look into how Apple designs its products.
