SC collegium defers reiteration of Justice Joseph's elevation to top court

SC Collegium Again Defers Decision to Re Recommend Justice K.M. Joseph

This is the third time the decision to recommend Uttarakhand Chief Justice has been deferred; Earlier the Collegium had met on May 2 and May 11.

According to the sources, since Justice K.M. Joseph's name had already been "in principle" reiterated at the last meeting, not much of Wednesday's discussion revolved around him. With the SC going for a summer break from May 18 till July 3, and Justice Chelameswar retiring on June 23, there is some uncertainty about when the collegium will meet again.

The Supreme Court collegium on Wednesday once again deferred the decision to re-recommend Chief Justice of Uttarakhand High Court, Justice K.M. Joseph for elevation to the Supreme Court.

The matter of the elevation of the Chief Justice of Uttarakhand High Court was stalled last month, as Centre had refuted to clear his name, while Indu Malhotra, who was recommended in the same meeting, sworn in last month.


Official sources said those high court judges who are in the race to be elevated to the apex court are Chief Justice of Madras High Court Indira Banerjee, who is originally from the Calcutta HC; Gujarat HC Chief Justice R Subhash Reddy, whose parent cadre is Telangana and Andhra Pradesh HC, and Karnataka High Court Chief Justice Dinesh Maheshwari, who is originally from Rajasthan HC.

The central government had in April asked the collegium to reconsider elevation of Uttarakhand HC Chief Justice Joseph, which had sparked off allegations that his promotion was being stalled because of his order a year ago that had resulted in President's rule being vacated from Uttarakhand.

The collegium intends to send Justice Joseph's name along with other names being considered for Supreme Court judgeships. During the May 11 meeting of the collegium, sources said Justices Chelameswar and Kurian Joseph had pitched strongly for reiteration of Justice K M Joseph's name and insisted on sending his name alone to the government for quick elevation to the SC.

Justice Jhala's name has been approved after taking into consideration the material on record.
