SCOTUS Paves Way For Legalized Sports Betting Outside Nevada

By a vote of 7-2, the justices declared that the federal ban on sports wagering is unconstitutional.

"The legalization of sports gambling requires an important policy choice, but the choice is not ours to make". The ruling strikes down the 1992 federal anti sports gambling law.

State officials have been pushing for almost a decade to legalize sports gambling. The case is Murphy v. NCAA.

States can legalize sports gambling, the Supreme Court ruled.

West Virginia - The Lottery Commission which will oversee sports betting, is on record as saying the state will be ready to implement sports betting within 90 days of a Supreme Court decision.

West Virginia and 17 other states, and the governors of three more, sided with New Jersey in the case. It exempted Nevada, where sports betting has always been legal, along with sports lotteries in Delaware, Montana and Oregon.


This clearly is a huge development as it pertains to the National Football League, one of the most heavily bet American sports - previously both legally in places such as Las Vegas and illegally. However, the state later changed its mind and passed a law to allow sports betting.

Casino chain MGM Resorts said last week when meeting analysts that it believes 10 to 12 states could legalize sports betting fairly quickly after a favorable ruling. It simply prohibits sports betting in the states.

The controversy started in 2011, when New Jersey voters approved a measure to legalize sports betting to help the casino industries in a faltering economy.

Mississippi - Gaming Commission Deputy Director Jay McDaniel has previously stated that the state would need a few months to propose regulations and have them approved following a Supreme Court decision, but that implementation before the end of 2018 would be feasible.

They argued that a state law legalizing sports betting is preempted by existing federal law.
