German court: Catalan politician can legally be extradited

A German court chose to allow the extradition of Catalan separatist leaderCarles Puigdemont to Spain, on a charge of misuse of public funds, a blow to the Spanish authorities' bid to bring him back to stand trial on the more serious charge of rebellion.

"Extradition on the accusation of misappropriation of public funds is permissible; extradition on the accusation of rebellion is not permissible", the superior regional court of Schleswig-Holstein state said in a statement.

He was arrested in germany on March 28, with the spanish government accusing him of of rebelling and misappropriating public funds. He was arrested on his way back from a trip to Finland.

The decision means that if he is extradited, Puigdemont can only stand trial in Spain on embezzlement charges over allegations he misused public funds, court spokeswoman Christine von Milczewski said.

A second charge of rebellion did not warrant an extradition from Germany to Spain, the court ruled.

The court also ruled, however, that the deposed leader's actions in Catalonia do not meet the definitions of high treason or breach of the peace and the violence triggered by the bid for independence did not pose a severe threat to Spanish rule.


"The amount of violence required for the charge of high treason was not seen in the altercations in Spain".

"We have demolished the biggest lie propagated by the [Spanish] state", Puigdemont wrote today on Twitter.

"The German justice system denies that the referendum on October 1 was rebellion", he said, referring to the independence vote that went ahead despite a court ban and was marred by police violence.

"Every minute spent by our colleagues in prison is a minute of shame and injustice".

Meanwhile, new Catalan president Quim Torra met Nicola Sturgeon in Edinburgh on Wednesday, in an event that represented the "starting point" for a close relationship between Catalonia and Scotland. Before he closed this part of the proceedings, he ordered Puigdemont, Oriol Junqueras, and the four other politicians who are being held in pre-trial custody (Raül Romeva, Jordi Turull, Josep Rull and Jordi Sànchez) to be suspended from their roles as deputies in the Catalan parliament.
