But Kavanaugh is, I believe, a careful and judicious guy and probably has been all along.

At the White House Monday, Kavanaugh invoked the value of legal precedent again, saying, "a judge must interpret the Constitution as written, informed by history and tradition and precedent".

Graham told reporters after his meeting that he has known Kavanaugh since the nominee held several key positions working for Bush in the White House. Republicans, meanwhile, hope centrist Democrats running for re-election in conservative-leaning states will back Kavanaugh.

The focus is on GOP Sens. Susan Collins of ME and Lisa Murkowski of Alaska. What we know is that at least two Democrats facing tough reelection campaigns in red states are positioning themselves to vote to confirm Kavanaugh if it seems politic to do so. The president has faced allegations of sexual harassment and remains under investigation for obstruction of justice in the Russian Federation election meddling investigation.

Congress, he wrote in The Minnesota Law Review, should pass a law that would temporarily protect the president from both civil suits and criminal prosecution.

Before he was a judge, he ran an investigation into the death of a deputy adviser to President Bill Clinton.
