NY state revokes approval of Charter-Time Warner Cable deal

They ordered Charter, doing business as Spectrum, to file a plan within 60 days to ensure an "orderly transition to a successor" provider or providers.

The commission alleges Charter has repeatedly failed to meet deadlines for improving internet speeds and has attempted to skirt obligations to provide high-speed internet to rural communities.

Regulators in NY are reneging on their approval of Charter Communications acquisition of Time Warner Cable, alleging the cable provider broke its promise to deliver high-speed broadband to rural customers.

NY announced Friday that Charter Communications, Inc., doing business as Spectrum, is no longer permitted to serve customers in the state. New York Gov. Andrew M. Cuomo (D) has not shied away from criticizing Charter for its delays; in May, he foreshadowed regulators' decision by saying the public service commission had initiated "legal action" against the company.

Charter also must pay the commission another $1 million in fines, on top of $2 million already paid.


"The time has come for stronger actions to protect New Yorkers and the public interest", said John Rhodes, chairman of the New York Public Service Commission. A key complaint centers on the company's commitment to expand its broadband network to underserved areas.

On Friday, the state Public Service Commission began the process of revoking its approval for the Charter-Time Warner Cable merger.

The state is also seeking $3 million in penalties from Charter, officials said.

"In the weeks leading up to an election, rhetoric often becomes politically charged", Charter said in its statement. But the fact is that Spectrum has extended the reach of our advanced broadband network to more than 86,000 NY homes and businesses since our merger agreement with the PSC. Mr. Wu previously worked as the NY attorney general's senior enforcement counsel and battled Charter over an investigation into internet speeds. The company said its workers "remain focused on delivering faster and better broadband to more New Yorkers, as we promised".
