Scott Frakes, director of Nebraska's Department of Correctional Services noted in an affidavit that lethal substances "are hard, if almost impossible, to obtain" in many death penalty states.

Tuesday's execution comes a little more than three years after Nebraska politicians abolished the death penalty, only to have it reinstated the following year through a citizen ballot drive partially financed by Republican Governor Pete Ricketts. "The state continues to carry out the sentences ordered by the court".

Last week, German drug maker Fresenius Kabi challenged Nebraska with regards to two other drugs in the protocol, claiming the company was the likely source of the substances, and if so, Nebraska improperly obtained them.

Department Chief of Staff Dawn-Renee Smith says the curtain was lowered after the execution team notified Department Director Scott Frakes that the last drug had been injected.

Witnesses said he coughed several times before going still, and it was then that his face gradually turning from red to purple.

Moore, who killed two taxi drivers five days apart in 1979 and was one of the longest-serving death row inmates in the USA, declined to make a last- minute appeal.

"There's no particular reason why one would use fentanyl", said Robert Dunham, executive director of the nonprofit Death Penalty Information Center.

Though Moore did not seek a reprieve, two pharmaceutical companies whose drugs were to be used in the lethal cocktail attempted to stop the execution to preserve their reputations, the Times previously reported.

Nebraska has carried out its first execution since 1997 with the lethal injection of Carey Dean Moore, who fatally shot two cab drivers nearly four decades ago.


The light turnout stands in contrast to the 1994 execution of Harold Lamont Otey, when more than 1,000 people created a raucous, party-like atmosphere.

"No one has used it before, and we've had hundreds and hundreds of executions by injection".

Moore was one of the nation's longest-serving death row inmates. The governor, a wealthy former businessman, has said he was fulfilling the wishes of voters in the conservative state.

Amid two lawsuits from drug companies to stay the execution, Moore had told his lawyers he wanted to be executed.

After Nebraska legislators overrode Ricketts' veto to outlaw the death penalty in 2015, he responded by personally investing money in a referendum to restore the death penalty, which passed the following year.

About 15 minutes after the execution began Moore was pronounced dead. More than 150 people gathered outside the Nebraska Capitol later in the day to protest the execution.

"Rather than joining those states that have turned against this cruel and irrevocable punishment, Nebraska chooses to take a backward step that provides no constructive solutions to the challenges posed by violent crime", said Kristina Roth, Amnesty's senior program officer for criminal justice.
