Prosecutors Want Bill Cosby Declared a ‘Sexually Violent Predator’ as Sentencing Starts

Bill Cosby to be sentenced for sexual assault, could face 30 years in prison

In this instance, "the judge is going to get flak", he said. Neighbours and schools will be warned he is living nearby.

"He seemingly thinks that he hasn't done anything wrong".

Montgomery County District Attorney Kevin Steele rejected the notion that "age, infirmity, should somehow equate to mercy".

Defence lawyer Joseph Green argued that one factor in branding a "sexually violent predator" was the risk of re-offending - and that the literature shows that risk declines with age. But Deborah Tuerkheimer, a law professor at Northwestern University and an expert on sexual assault cases, said Cosby's case, as well as the election of US President Donald Trump in 2016, helped "seed the ground" for the coming wave. He said the legally blind 81-year-old would have few opportunities to meet and victimise anyone else.

Judge Steven O'Neill is also expected to decide whether to declare Cosby a "sexually violent predator" - a scarlet letter that would make him subject to mandatory lifetime counseling and community notification of his whereabouts.

If he must serve time, he could be taken into custody immediately after the judge pronounces the sentence.

At the end of the potentially two-day hearing, Montgomery County Judge Steven T. O'Neill could sentence Cosby to as many as 30 years in prison or send him home on probation. The state sentencing guidelines indicate 22 to 36 months in prison, plus or minus 12 months because of aggravating or mitigating circumstances.

"[The movement] may have influenced the judge's willingness to allow more witnesses", Orenstein said.

Constand will make a statement during the hearing, according to multiple reports.

"I have given you my victim impact statement". Cosby shouted: "He doesn't have a plane, you asshole!" "All I'm asking for is justice as the court sees fit".

A psychologist for the prosecution said that Cosby had a mental disorder that gave him "uncontrollable urges" against non-consenting women. She said people who commit this sort of aberrant sexual behaviour, which she described as a form of paraphilia, were likely to reoffend.

The doctor in question, Dr. Timothy Foley, is unavailable until Tuesday morning at the earliest.

"Despite bullying tactics, despite PR teams and other folks trying to change the optics, as one lawyer for the defense put it, the bottom line is that nobody's above the law".

Lublin and former model Janice Dickinson - another Cosby accuser - were among those in the courtroom today.

Several of the Cosby accusers who were in Pennsylvania for the trial have returned, including Lili Bernard and Therese Serignese.

Andrew Wyatt spoke to reporters as he walked into a suburban Philadelphia courthouse Monday afternoon.

O'Neill last week denied prosecutors' request to present "numerous" witnesses who would testify that Cosby sexually abused them in incidents that did not result in criminal charges, court records show.

"Mr. Cosby's frustration got the better of him and he used a name towards Mr. Steele he shouldn't have", Green said.

Cosby was the first celebrity to go to trial in the #MeToo era and could be the first to go to prison - perhaps for the rest of his days - after being convicted in April.

Cosby, who was found guilty in April, is the first celebrity to face a possible prison sentence since the start of the #MeToo movement, the national reckoning with sexual misconduct that has brought down dozens of powerful men in entertainment, politics and other fields.
