Trump Considers Terrifying New Policy to Eliminate Transgender Rights

Trump administration reportedly considering denying recognition of transgender people only defining gender as sex assigned at birth

Perhaps most worryingly, the report also goes on to claim that the department urges the administration to determine a more rigorous and uniform definition of gender "grounded in science" and that a person's sex, once identified, be unchangeable.

According to a memo obtained by the New York Times, the Department of Health and Human Services is leading an effort to establish a legal definition of sex under Title IX, the federal law that prohibits gender-based discrimination.

It's still unclear what exactly would unfold (and when/how it'll happen) should the Trump administration get its wish with this narrow definition, but one thing is clear: they are VERY much intent on rolling back progressive achievements that took place under Obama.

Transgender rights activists are calling for protests outside the White House on Monday, after reports that the Trump administration was planning new reversals to Obama-era recognitions of gender fluidity.

According to the memo seen by the NYT, the HHS proposes that "Sex means a person's status as male or female based on immutable biological traits identifiable by or before birth".

"The sex listed on a person's birth certificate, as originally issued, shall constitute definitive proof of a person's sex unless rebutted by reliable genetic evidence", the memo says, according to the Times.

The Anti-Defamation League immediately came out against the move, writing on Twitter that such a decision would be "heartless and destructive".

"Defining "sex" in this narrow language tailored to the talking points of anti-equality extremists is part of a deliberate strategy to eliminate federal protections for LGBTQ people", the group's president, Chad Griffin, said in a statement.

The Trump administration has already sought to bar transgender people from serving in the military and has challenged other civil rights protections.

The US State Department under Trump has not filled a position created by former secretary of state John Kerry of a special envoy advocating LGBT rights around the world.

Under the Obama administration, the legal concept of gender was loosened through a series of decisions, recognizing gender as an individual choice and not one determined at birth. In next month's midterm elections, Christine Hallquist hopes to become America's first transgender governor, in Vermont. This would result in loss of rights ranging from housing to healthcare to education.

Civil rights groups have been meeting with federal officials in recent weeks to argue against the proposed definition, which has divided career and political appointees across the administration.

Health and human services officials said they were only abiding by court orders, referring to the rulings of Judge Reed O'Connor of the US District Court in Fort Worth, Texas, a George W. Bush appointee who has held that "Congress did not understand "sex" to include "gender identity".

But in recent discussions with the administration, civil rights groups, including Lambda Legal, have pointed to other court cases.
