If Mr Whitaker made a decision to fire Mueller, he would need to inform the special counsel in writing of the specific reason for his termination.

As attorney general, Sessions cracked down on illegal immigration, vowing to enforce federal law.

The investigation has produced 32 criminal charges and guilty pleas from four former Trump aides.

Mr Mueller could seek to challenge his own firing if he felt Whitaker lacked the good cause required by the special counsel regulation, said Mr Ohlin. A court might then issue a temporary restraining order blocking his removal.

"I look forward to working with President Trump to find a confirmable, worthy successor so that we can start a new chapter at the Department of Justice and deal with both the opportunities and challenges our nation faces", he said in a statement online. The former attorney general submitted a letter of resignation at the president's "request".

The possibility that Sessions was sacked could open Whitaker's appointment to court challenge by a range of people, including Mueller, impacted by his actions.

That left Rosenstein overseeing the investigation, and he named Mueller as special counsel.

How could Whitaker impede Mueller without firing him? He also obtained indictments against Russian individuals and companies accused of a sweeping conspiracy to hurt Democrat Hillary Clinton and ultimately to help Trump win.

In that scenario, Mueller's budget could be reduced "so low that his investigation grinds to nearly a halt", Whitaker said during an interview with CNN in July 2017 before he joined the Justice Department.

Short of legislation meant to protect Mr Mueller, which is unlikely to pass, there is little Congress can do to challenge Mr Whitaker's oversight of Mr Mueller, said Mr Rosenzweig.
