Nintendo Wins $12.2M in Lawsuit Against ROM Site Owners

A settlement has been reached between the publisher and the owners of two Nintendo ROM emulator websites, to the amount of $12 million.

The video game company filed a complaint against LoveROMS.com and LoveRETRO.co in July, stating the websites were "built nearly entirely on the brazen and mass-scale infringement of Nintendo's intellectual property rights".

The lawsuit initially resulted in LoveROMS and LoveRETRO pulling all Nintendo titles from its roster, with both websites going offline shortly after.


"Plaintiff is hereby awarded judgment against all Defendants, jointly and severally, in the amount of $12,230,000", the judgement reads. Nintendo and the married couple have been involved in settlement discussions, and now it appears they're one step closer to bringing the legal drama to a close.

"Our website, LoveROMS.com/LoveRetro.co, previously offered and performed unauthorized copies of Nintendo games, in violation of [] copyrights and trademarks".

LoveRetro.co acknowledges that it caused harm to Nintendo, its partners, and customers by offering infringing copies of Nintendo games and has agreed to cease all such activities. "This includes thousands of games developed for almost every video game system Nintendo has ever produced". Nearly immediately, those sites were taken down as Nintendo sought damages that could have potentially totaled as much as $100 million. In addition to the fine, the settlement contains an injunction that will prevent the couple from infringing on Nintendo's copyrights in the future. The site's library included games for Nintendo devices as well as other consoles, such as PlayStation and Atari. According to Nintendo, LoveROMs itself had about 17 million monthly visitors, and was earning revenue through online ads and donations.
