Apple Appeals Court Order Banning iPhone Sales In China

Speaking to the Financial Times in an interview, Qualcomm's attorney Jiang Hongyi said that the company will argue that Apple (aapl) violated two of its patents in its latest iPhone models and will use that as a basis to have them removed from Chinese store shelves.

Now Apple seems to be internalizing cellular modem design duties at the expense of Intel and Qualcomm, and the two semiconductor firms may be the reason it's going in-house.

"Apple continues to benefit from our intellectual property while refusing to compensate us. These Court orders are further confirmation of the strength of Qualcomm's vast patent portfolio", Don Rosenberg, Qualcomm executive vice president and general counsel, said in a statement online.

"All iPhone models remain available for our customers in China", Apple added.

On Monday, Apple filed a request for the court to reconsider its decision.


Apple and Qualcomm are locked in a wide-ranging legal dispute in which Apple has accused Qualcomm of unfair patent licensing practices.

Qualcomm was said to have withheld over $1 billion in rebates owed to them over the fact that Apple gave information to legal authorities, which may have led to an $857 million United States dollars fine levied against Qualcomm in South Korea.

Apple had also said its three models released in September were not part of the case.

The court action also comes amid a backdrop of increased trade tensions between Washington and Beijing and the arrest in Canada of a top executive of Chinese tech giant Huawei at the request of USA authorities.

Apple's most recent quarterly report showed it brought in some $11 billion around 18 per cent of its total revenues from "Greater China", a region which includes Taiwan and Hong Kong. What's more, The Information spoke to "a person briefed on Apple's plans", who confirmed that the company does indeed have an active project to build its own cellular modem chip for use in iPhones.
