Netflix sued over Bandersnatch's similarities to Choose Your Own Adventure

The big gimmick associated with Netflix's buzzy Black Mirror movie Bandersnatch is that it's very much a choose your own adventure kind of production.

The trademark lawsuit was filed in Vermont on Friday and surrounds the "Choose Your Own Adventure" books, which have allegedly been trademarked and in production since 1980.

TMZ reports the streaming giant has been hit with a $25M lawsuit by the creators of "Choose Your Own Adventure" over the latest installment in the Black Mirror series.

According to a January 11th, 2019 Hollywood Reporter story, US -based publisher Chooseco filed documents in Vermont arguing that the publisher has used the phrase since the 1980s and has sold more than 265 million copies of its Choose Your Own Adventure books.

Chooseco claims the "grim content" included in Black Mirror: Bandersnatch tarnishes their name and the dark themes in the film are too mature for their audience.


Bandersnatch, directed by Charlie Brooker, was released in December previous year and allows the viewer to chose their own destiny during the film, where they ultimately go on to pick their own ending.

The suit also notes that 20th Century Fox recently optioned the rights to create a film based on the series, which is now in the works. However, they say Netflix never got the license to use it.

"The misappropriation of our mark by Netflix presents an extreme challenge for a small independent publisher like Chooseco", the complaint states.

According to Chooseco's complaint, "Netflix has no license or authorization to use Chooseco's trademark and, upon information and belief, used the mark willfully and intentionally to capitalize on viewers' nostalgia for the original book series from the 1980s and 1990s".

A Netflix spokesperson declined to comment. The book series has also been licensed for translation and distribution in 27 other countries. The company has filed for at least $25 million for "infringement, dilution, and unfair competition" and demands that Netflix remove any "choose your own adventure" references relating to Bandersnatch.
