Judge Sides With Apple in $1 Billion Qualcomm Dispute

Jury decision means Apple must pay Qualcomm $31 million

That works out to $1.41 for each iPhone sold without a license for the Qualcomm technology used inside each device.

Although the Court today did not view Apple's conduct as a breach of Apple's promises to Qualcomm in the 2013 Business Cooperation and Patent Agreement, the exposure of Apple's role in these events is a welcome development.

A third patent related to promoting rich graphics in games while protecting battery life, according to Qualcomm.

"Qualcomm's ongoing campaign of patent infringement claims is nothing more than an attempt to distract from the larger issues they face with investigations into their business practices in US federal court, and around the world", an Apple statement notes. Apple has sought to dismantle what it calls Qualcomm's illegal business model of both licensing patents and selling chips to phone makers.

It's hard to believe the arrangement between Qualcomm and Apple was established in the first place.


"Today's unanimous jury verdict is the latest victory in our worldwide patent litigation directed at holding Apple accountable for using our valuable technologies without paying for them", said Don Rosenberg, Qualcomm executive vice president and general counsel.

For Qualcomm, it shows the San Diego-based company's contribution to the iPhone's success and sets up an even bigger trial against Apple over billions of dollars in patent royalties.

This legal victory for Qualcomm is just the warmup from another showdown that will take place in the USA next month (April 15). Today, however, Qualcomm was the big victor as a US jury handed the chip company a $31 million judgement in its favor. Qualcomm was then supposed to reimburse Apple for the fees, provided the company didn't complain to regulators or attack Qualcomm in court.

In the trial that just concluded, the jury unanimously agreed with Qualcomm's contention that it should be paid $1.41 per iPhone relying on three of its patents. It also claimed that Apple made "false and misleading" statements during a Korean Fair Trade Commission investigation into Qualcomm. But it does not say much about the value of Qualcomm's entire patent portfolio and was unlikely to spark settlements discussions, he said. "This isn't something that will bring Apple to the table with any sense of urgency", Kroub said.
