Boeing reports another big drop in deliveries in 3Q

The lawsuit, filed in the District Court of Dallas County, Texas, alleges that Boeing "abandoned sound design and engineering practices, withheld safety critical information from regulators and deliberately misled its customers, pilots and the public about the true scope of design changes to the 737 MAX". SWAPA estimated that the 737 Max grounding had wiped out more than 30,000 scheduled Southwest flights, reducing the airline's passenger service by 8 per cent by the end of 2019. Its European Union counterpart said it was in "continuous contact" with both the FAA and Boeing.

Boeing called the lawsuit meritless and has pledged to vigorously defend itself.

The US Federal Aviation Administration (FAA) said in a statement that it has a "transparent and collaborative relationship" with other civil aviation authorities as it continues its 737 MAX safety review, while its European Union counterpart said it was in "continuous contact" with both the FAA and Boeing.

As part of the suit filed on Monday, the pilots accused Boeing of misleading Southwest's labor union about the status of the plane.


SWAPA also said that had the union known the truth about the 737 MAX in 2016 it wouldn't have agreed to fly it and would have demanded Boeing fix the flaws of the aircraft that led to the Lion Air Flight 610 and Ethiopian Airlines Flight 302 crashes.

This has already resulted in lost compensation to pilots of more than $100 million, the complaint states, and the grounding is still ongoing.

The crashes forced Boeing to undergo a rocky recertification process for the plane, and pushed the Federal Aviation Administration to review its process for approving planes for flight.

Within the third quarter, Boeing delivered 63 jetliners, down from 190 jet shipments a 12 months earlier. In the most recent quarter, Boeing reported its largest loss ever - a $3.7 billion adjusted loss - as a result of the grounding. Boeing is fighting to get the jet back in service this year. In addition to the 34 Max aircraft Southwest had when the plane was grounded, the airline expected another 41 to be delivered and had built its flight schedule around that. American Airlines Group and United Airlines have canceled 737 MAX flights through part of December.
