Will the United States supreme court uphold basic protections against discrimination?

SCOTUS takes on DACA, LGBTQ rights in new term

The Trump administration says that is what the Supreme Court should find as well.

The conservative group "Alliance Defending Freedom", which successfully backed a baker who refused to make a wedding cake for a gay couple and whose case ended up before the Supreme Court, has also weighed in on the side of employers. The Court's newest justice, Brett Kavanaugh, comes in at a close second. Though a moderate conservative, Kennedy wrote all of the court's opinions upholding the rights of gays and lesbians, including the 2015 decision upholding the right to marry for same-sex couples.

We can not ignore what these three cases, and the social and legal questions they present, are really about: the rights of everyone to work free from the limitations of sex stereotypes. Lower courts have blocked Trump from ending the Obama-era program, which has shielded roughly 700,000 people from deportation and provided them with permits to work. Kavanaugh, whose approach to gay rights is unclear, could provide a pivotal vote.

Although these cases may seem to be only about LGBT rights, the reality is that everyone stands to lose basic workplace protections against discrimination if the high court rejects these workers' claims. Gerald Bostock claims he was sacked from his job as a social worker in Clayton County, Ga., after he became more open about being gay, including joining a gay softball league. Norton, the first woman to chair the Equal Employment Opportunity Commission (EEOC), believes that both sexual orientation and gender identity are essential parts of a person's sex and therefore should be protected under Title VII. A ruling against the plaintiffs would mean gay and transgender people in those states would have few options to challenge workplace discrimination. He died after the case began and the matter is being pursued by his estate.

The Supreme Court will start by hearing the cases of Donald Zarda and Gerald Lynn Bostock.

Aimee Stephens said she was sacked from her job at a family-run funeral home in Detroit after she returned from a vacation as a woman. His administration has supported the right of certain businesses to refuse to serve gay people on the basis of religious objections to gay marriage, restricted transgender service members in the military and rescinded protections on bathroom access for transgender students in public schools.

Under President Trump, the Justice Department will argue that the law should not cover gay, lesbian and transgender workers.

Big business, typically eager to avoid liability in employment disputes, is backing the LGBT plaintiffs.
