Inmate claims he completed life sentence by dying

An Iowa prisoner serving a life sentence argued he had paid his debt to society - after "dying" momentarily in hospital.

His case was denied by the Iowa Court docket of Appeals on Wednesday.

In Schreiber's claim, filed past year, he said that he had been resuscitated against his will, and that his brief "death" meant that his life sentence had technically ended.

Doctors administered IV fluids and operated on Schreiber to fix damage done by kidney stones, the paper added.


While appealing his sentence, Schreiber said that medics did not adhere to his "do not resuscitate" order.

Medical staff called his brother in Texas, who told them that if Schreiber was in pain, they could give him something to ease it, court records reportedly said.

"We do not find his argument persuasive", Judge Potterfield wrote, adding that the judges found it unlikely the Legislature would have wanted "to set criminal defendants free whenever medical procedures during their incarceration led to their resuscitation by medical professionals".

And Potterfield doubts that Schreiber's interpretation of the law could possibly be what lawmakers meant when they defined a life sentence.
